Whom the Training is Intended
The
Training Service is intended for lawyers, professional engineers, managers
and quantity surveyors involved in construction and involved in resolving
disputes.
The
Aim of the Training
The
aim of the courses is to train selected people in the basic skills and
knowledge needed to achieve standards of competence to plan the project
commercial strategies as project managers, to manage the commercial aspects
of construction projects as site engineers, managers or quantity surveyors
and to resolve claims in construction projects as dispute managers.
The
Training Objectives
The
objectives of the Training Programme are to provide each selected delegate:
(1)
a working knowledge of contract law and commercial matters relating to
construction.
(2)
an understanding of the process of identification of risks to the
perceived objectives of the project and an awareness of the responses
available and appropriate commercial strategies to manage the risk
effectively.
(3)
a working knowledge of the operation of standard forms of contract on site
including issues such as programmes, access, delays, defects and
completion.
(4)
awareness of the procedures to be followed for variations, pricing
variations and claims for additional costs.
(5)
an appreciation of the difficulties involved in nomination and naming,
certification and payment under the standard forms.
(6)
an introduction to the procedures relating to termination and dispute
resolution.
(7)
an understanding of the legal basis of claims and in particular claims
under construction contracts;
(8)
an appreciation of relevant case-law on the analysis of claims on matters
such as certificates, extensions of time, disruption and global claims.
(9)
a working knowledge of the management of evidence necessary to establish
legal entitlement.
(10)
awareness of the management of claims and disputes resolution processes.
Training
Programme
The
Training Programme is
intended to allow delegates:
(a)
to formulate contract strategies
(b)
to use basic skills to manage the commercial aspects of construction,
under standard forms;
(c)
to identify contractual entitlements under standard forms.
(d)
to manage and prepare construction claims in a form which will allow early
identification and resolution of the issues.
(e)
to adopt the appropriate approach to disputes commensurate with the nature
and complexity of the issues.
