TRAINING

Daniel Atkinson as a non-practising barrister has provided legal, advocacy and arbitration services to the construction industry both in the UK and internationally.

Resolution of Disputes

Daniel Atkinson has provided Arbitration Services in both Domestic and International Arbitrations.  The Arbitration Record includes International and Domestic Arbitrations and a range of Arbitration Rules, with experience of jurisdictional issues and enforcement requirements of international arbitrations and with various arbitration rules as well as UK arbitrations.  The Service is based on approach which allows the Client to recognise and decide the extent its commitment required to achieve successful resolution by:

• A clear statement of the issues in dispute;

• An assessment of each of the dispute issues;

• Advice on the most appropriate means of resolution;

• An assessment of the time required for resolution, budget fees and the extent of involvement of our client's personnel.

Daniel Atkinson has provided Adjudication Services with  an understanding and knowledge of the provisions of the Housing Grants, Construction and Regeneration Act 1996 Part II and the Scheme for Construction Contracts Regulation 1998, and has acted as Adjudicator.

Daniel Atkinson can act in providing a  Conciliation Service.

Daniel Atkinson has provided a Mediation Service by representing a party in the process and acting as mediator and is a registered CEDR Mediator.

Daniel Atkinson has provided a Contractual Resolution Service by acting as  Advocate and the preparation of claims and settlement.

Legal Advice - Contracts

Daniel Atkinson can provide a Document Analysis Service to establish the allocation of rights and obligations of the parties and to identify the major risks, and provide advice on the commercial procedures to be adopted.

Daniel Atkinson can prepare Contract Strategies for projects and give advice on various contracting arrangements and procurement methods to allow informed choice of strategy.

Daniel Atkinson can Draft documentation to implement procurement strategies, including amended standard forms, warranties and bonds, contracts for Design and Construct, PFI, BOT, DBFO and other finance schemes.

Daniel Atkinson can provide Commercial Advice  on a regular or ad hoc basis during construction.

Training

Daniel Atkinson has provided training on a wide range of commercial matters. The Training Service includes legal issues, standard forms and resolution of disputes amongst the standard topics.
