ADJUDICATION RECORD

 

The following are only a selection of adjudications to demonstrate the extent of the experience of Daniel Atkinson.

  1. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The contract was a JCT IN/SC First Edition 1985 standard form of contract. Represented the Referring Party in the recovery of £26,000 in which a settlement was achieved recovering 75% of the amount claimed. Issues addressed in this adjudication included Variations and Measured Works. The primary issues was lack of notice of deduction by the Other Party.

  2. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The contract was a DOM/1 standard form of contract. Represented the Responding Party in the recovery of a sum of £630,000 in which a decision was given by the Adjudicator ordering immediate payment of 100% of the amount claimed. Issues addressed in this adjudication included Variations and Measured Works. The primary issues was lack of notice of deduction by the Other Party.

  3. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The Contract was a JCT IN/SC First Edition 1985 standard form of contract. Represented the Other Party in which £35,000 was claimed by the Referring Party. The matter was settled prior to the Adjudicator’s decision with no payment to be made by either party. Issues addressed in this adjudication included Loss and Expense, Extension of Time Variations and Measured Works. The primary issue was interpretation of the Contract.

  4. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The Contract was a DOM/1 standard form of contract. Represented the Referring Party in the recovery of a sum of £56,000 in which a settlement was achieved prior to the Adjudicator decision recovering payment of 70% of the amount claimed. Issues addressed in this adjudication included Variations and Measured Works. The primary issue was lack of notice of deduction by the Other Party.

  5. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The Contract was a JCT 1980 standard form of contract. Represented the Referring Party in recovery of a sum of £292,000 in which a settlement was achieved recovering 100% of the amount claimed. Issues addressed in this adjudication included Loss and Expense, Extension of Time, Variations and Measured Works. The primary issue was lack of notice of deduction by the Other Party.

  6. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contract. The Contract was for a sum of £139,000 in which a settlement was achieved recovering payment of 100% of the amount claimed. Issues addressed in this adjudication included Variations and Measured Works. The primary issue was lack of notice of deduction by the Other Party.

  7. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contacts. The Contract was the Other party’s own standard terms and conditions. Represented the Referring Party in the recovery of a sum of £159,000 in which a decision was given by the Adjudicator ordering immediate payment of £50,000.00 the other sums claimed did not form part of the Adjudicator’s decision and are being readjudicated. Issues addressed in this adjudication included Variations and Measured Works. The primary issue was lack of notice of deduction by the Other Party.

  8. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The Contract was the standard terms and conditions of the Other Party. Represented the Responding Party in the defence of a claim for £260,000. The Adjudicator awarded £100,000 to the Referring Party. Issues addressed in this adjudication included Loss and Expense, Extension of Time, Variations and Measured Works. The primary issue was interpretation of the Contract.

  9. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 in accordance with a JCT 1981 standard form of contract with amendment 12, therefore the Scheme did not apply. Represented the Referring Party in the recovery of a sum of £1,037,000.00 which is on going. Issues addressed in this adjudication include Loss and Expense, Disruption Extension of Time Variations and Measured Works. The primary issues is lack of notice of deduction by the Other Party.

  10. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 in accordance with a JCT IFC 1984 standard form of contract with amendment 12, therefore the Scheme did not apply. Represented the Responding Party in the recovery of a sum of £39,000.00. The Adjudicator awarded £36,500.00 to the Referring Party. Issues addressed in this adjudication included Variations and Measured Works. The primary issue was interpretation of the Contract.

  11. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The Contract was a RIBA Blue Book standard form of contract and an oral contract for additional work recorded in writing. Represented the Referring Party in the recovery of a sum of £25,500.00. The Adjudicator awarded £16,300.00 to the Referring Party. Issues addressed in this adjudication included professional services provided. The primary issue was interpretation of the Contract.

  12. An Adjudication under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts. The Contract was given orally and later recorded in writing. Represented the Referring Party in the recovery of a sum of £206,500.00 in which a settlement was achieved prior to the Adjudicator decision recovering payment of £195,000.00. Issues addressed in this adjudication included Variations and Measured Works. The primary issue was lack of notice of deduction bu the Other Party.

  13. An Adjudication conducted by agreement between the parties The Contract was based on IChemE Red Book.. Executive Director   acted as the Adjudicator in determining a dispute as to contractual interpretation. Issues addressed in this adjudication included Variations and Measured Works. The primary issue was contractual interpretation.
