Terms of Appointment as Adjudicator

These are my standard terms:
- Fees are to be calculated at £285 per hour for the time spent on or in connection with the
Adjudication, including but not limited to time spent on administration travelling and reading
documents and submissions and attending meetings.
- All disbursements (including the cost of such legal or other advice as I may, at my ultimate
discretion but after consultation with the parties, think it fit to take) to be charged at cost.
- All fees and expenses to be subject to the addition of Value Added Tax at the appropriate rate.
- Any documents supplied by the Parties will be disposed of 48 days after the date of my decision,
or returned to the party who supplied the documents on written request.
- Any fees and expenses not paid within the time limits specified shall be subject to the addition of
simple interest at 5% above the base rate of Lloyds TSB from time to time calculated from the
date the payment is due to the date of the actual payment.
- The Parties shall be jointly and severally liable for my fees and expenses including those of any
legal or technical adviser, but I may direct the Parties to pay all or part of the fees and expenses.
The Party requesting the adjudication is liable for my fees and expenses if the adjudication does
not proceed.
- I, my employees and agents, are not liable to the parties for an action or failure to take action in
the adjudication unless the action or failure to take action is in bad faith.
- The parties indemnify me, my employees and agents against claims, compensation and costs
arising out of my decision unless the decision was made in bad faith.

Daniel Atkinson holds the degree of barrister, but does not have a practising certificate because he does
not comply with the Bar Council's rules for practising barristers. This limits the work which he is allowed
to do. It also limits the rights you will have against him and against the Bar Council. He cannot appear in
court or conduct litigation or immigration work. Daniel Atkinson is not fully regulated by the Bar
Council. This means that, although the Bar Council can consider a complaint against him, it cannot
require him to pay you compensation for inadequate professional service. The Bar Council will also not
pay you compensation itself for any wrongdoing on his part. Full details are given at
