The enactment of the Arbitration Act 1996 has meant that Arbitration has the potential to provide a rapid and cost effective final resolution of disputes.  If Arbitration simply mimics litigation, then this defeats the main benefit of arbitration which is a private speedy resolution of disputes by professionals with knowledge of the industry.

International Arbitration has one distinct advantage over litigation, which is the relative ease of enforceability of arbitrator's awards due to the recognition by many legal systems of the New York Convention.
