World Wide Experience

Daniel Atkinson has represented Claimants and Defendants in construction arbitrations under different legal systems.  International Arbitration raises particular legal issues including procedural matters related to the law of the seat of arbitration, the rules of evidence which apply and enforcement issues as well as issues in Conflict Law.  There are also issues which relate to the culture of the parties.

Daniel Atkinson has a Diploma in International Arbitration having been awarded the Cedric Barclay Prize by the Chartered Institute of Arbitrators in 1998.

International Arbitrations

Arbitration is essentially a private matter so only general information will be given.  The following general descriptions indicate the breadth of experience of Daniel Atkinson:

  1. International Arbitration under English Law with the seat of arbitration in Switzerland under UNCITRAL Rules representing the Respondent for construction of a petrochemical facility in Africa. Preparation of Defence and Counterclaim, documentary exhibits and witness statements and taking full conduct of the arbitration leading to a successful settlement.

  2. International Arbitration under the Law of Belarus and ICC Rules with the seat of arbitration in France representing the Respondent. Preparation of the Defence and Counterclaim, documentary exhibits and Witness Statements and taking full conduct of the arbitration leading to a successful settlement.

  3. International Arbitration under Danish Law with the seat of arbitration in Denmark for the design and manufacturing of Tunnel Boring Machines, representing the Claimant. Responsible for preparation of the submissions for variations and delays, including management of documentary and witness evidence, and assisted the foreign advocate in the preparation of the Statement of Case, leading to a successful settlement.

  4. International Arbitration under English Law with the seat of arbitration in England under ICC Rules representing the Claimant for the bridge construction in the Indian Continent. Responsible for preparation of the statement of Case, Exhibits and instructing Experts and Queen's Counsel with full conduct of the arbitration leading to successful settlement.
