Daniel Atkinson is involved in all aspects of adjudication and actively promotes this method of dispute resolution.  He write regularly on Adjudication Law and is a past chairman ICE Committee.  He acts as Adjudicator and represents parties.  Adjudication is essentially private between the parties so no detailed  information will be given, but the following show the types of adjudications to show the breadth of experience.

  1. Acting as Adjudicator on
    1. many disputes under the Housing Grants Construction and Regeneration Act 1996 and the Scheme for Construction Contracts on issues of valuation of works and entitlement to withhold payment, including preliminary issue of jurisdiction.
    2. many disputes under JCT Forms and DOM Forms and the rules therein on issues of valuation of works, extensions of time and loss and expense, including preliminary issue of jurisdiction.
    3. many disputes under ICE and NEC Forms and the ICE Adjudication Procedure on issues of valuation, variation, delay and disruption, extensions of time and substantial completion, as well as ground conditions.
    4. many disputes under bespoke process contracts on issues of jurisdiction, valuation and determination.
    5. many disputes under IChemE forms on ground conditions, payment and the principles to be applied on valuation of variations.
  2. Representing either for the Referring Party or for the Responding Party on all types of disputes and standard forms of contract, and on bespoke forms.  The representation has involved legal analysis of the substantive issues, the application of Adjudication Law, the preparation of Notices or the Response Documents, communications with Adjudicators on procedural issues, representation at hearings and meetings and advising on enforcement issues.
